Brexit: Update on negotiations and implications of a no-deal on marketing activity in the EU

With less than 10 weeks remaining until the end of the Brexit transition period, member firms should now be carefully reviewing their contingency plans to ensure they can continue to service European business no matter the outcome of negotiations. Critically, absent an over-arching equivalence determination for the UK, firms will now likely have to rely on a patchwork of national regimes and licence exemptions to keep servicing their continental business and to look for new opportunities. But this gives rise to several practical difficulties, especially for smaller firms, such as how to structure client support, sales and distribution teams, and what type of marketing activity can still be carried out from the UK with options ranging from third country licenses, chaperoning arrangements to secondments.
